Terms and Conditions for Roofing & Home Improvement Estimates
By signing the estimate, you are confirming you have reviewed and agree to the terms and conditions
listed below.
NOTE: If additional layers of roofing materials are discovered during the removal process, there will be
an additional charge of $40.00 & “per square” (Per additional layer) added to the original contracted
amount.
Lumber/sheathing replacement to be billed in addition (if necessary) to contracted amount as follows:
- 7/16” OSB@ $100.00 per sheet
- 5/8” or 3/4” OSB@ $120.00 per sheet
- 7/16” or 1/2” Plywood@ $120.00 per sheet
- 5/8’ or 3/4” Plywood@ $150.00 per sheet
- 1x sheathing boards@ $8.00 per LF
- 2x Lumber or Fascia @ $12.00 per LF
Chimneys: TJC Home Improvement is not responsible for deteriorating chimneys, chimney caps, mortar or brick. If there is an existing chimney leak that has occurred above the flashing line, the leak is not the responsibility of TJC Home Improvement. If it is requested for the chimney to be removed down to the roof line, a letter from an HVAC professional will need to be provided before scheduling the roof installation. The HVAC will be the responsibility of the homeowner.
Skylights: If the customer chooses to reflash rather than replace the skylight, the skylight will not be included in the warranty of the roof.
Gutter Guards: Customer can have previous installer remove and reset existing gutter guards/helmets. If they are not removed prior to roof installation, TJC Home Improvement LLC will remove the gutter guard system and will NOT replace them. TJC Home Improvement LLC will not be liable for the re-installation of existing gutter guards.
In the event a punch list occurs, TJC Home Improvement LLC reserves the right to collect 90% of the total project cost. The customer may retain 10% of the total project cost until the entire punch list is satisfied. Punch list to be completed by TJC Home Improvement, LLC within seven (7) days. 90% collection is still required upon substantial completion to avoid additional interest. Please see payment policy below.
The Customer understands that payment in full is due upon completion of work as stated in the contract. All invoices not paid in full within three (3) days will be subject to a $500 late payment charge and a 2% per month interest charge on any unpaid balances.
TJC Home Improvement, LLC will do everything possible to protect both the inside and outside of your home but will not be held responsible for incidental or accidental damages that may occur to plants, shrubs, gardens, lawns, ornamentals, and lighting outside the home as well as ceilings, drywall, and fixtures inside the home. In most cases, tarps/covers are used outside the home to protect vulnerable areas, and we recommend to our customers that they remove valuable items such as paintings, pictures, loose lighting fixtures, knick-knacks, urns, and such from shelves and/or walls to avoid damage from pounding and vibrations.
Also, in situations where skylight units are involved, we highly recommend that our customer move any loose items situated underneath the skylight units and cover the immediate area underneath with a tarp or drop cloth as it is likely that some small amounts of roofing debris may fall during the roofing process. Any existing roof-top equipment that is re-installed with the new roof system will not be covered under the 1-year workmanship or the limited materials warranty by the manufacturer. It is to be considered discretionary, and “after-the-fact” replacement shall be the responsibility of the homeowner. (This includes any/all roof penetrations, equipment, and skylight units).
NOTE: It is inevitable that dirt, dust, and debris will fall into the attic/crawlspace through the cracks in the sheathing during the re-roofing process. The process of tearing off the old roofing materials and hammering makes this impossible to avoid.
Therefore, it is the customer’s responsibility to remove or cover any items stored in the attic/crawlspace prior to commencement of the project.

- 1, Description of Services and Materials - Beginning on the day of commencement,
TJC
Home Improvement LLC shall perform any and all tasks and duties outlined in the
scope of work in this estimate, and provide all materials and supplies listed, subject
to the terms and conditions of the Parties’ Agreement. “Our Services” are normally
performed between the hours of 6:00am-8:00pm, Monday through Saturday,
excluding holidays, unless the Parties mutually agree otherwise. Please keep in mind
that Our “Services” will only be performed if the weather conditions are favorable
to ensure safe working conditions and an acceptable finished product.
- 2, Compensation - **Payments made with Credit/Debit Card(s) will be subject to
additional fees. TJC Home Improvement, LLC agrees to perform the specified Services
and provide all necessary materials, supplies, and labor pursuant to this agreement.
When services are complete the bill must be paid in full. No warranty will be granted
until payment is PAID IN FULL. Payments are required on the day of completion. (See
payment policy above.)
- 3, Additional Expenses - In addition to the agreed compensation described in
section 2,
the Customer agrees to pay TJC Home Improvement, LLC for all reasonable and
necessary “unforeseen” additional expenses that may arise or be incurred during the
project. Normally, these additional expenses are related to the replacement of rotten
and/or damaged lumber found during the removal of the existing roofing materials.
Since “timing” is critical in the replacement of any (found) rotten and/or damaged
lumber, it is not always possible to contact and/or reach the Customer to inform/advise
them of the additional expenses, while it’s happening. TJC Home Improvement, LLC will
exhaust every possibility to reach the Customer or their representative when possible
and will make every effort to ”minimize” any additional expenses regardless. Upon
request TJC Home Improvement, LLC will provide receipts for additional materials used
and attempt to provide photo verification of additional work completed in these areas.
These additional expenses will be added to the total sum of the original contracted
amount.
- 4, Termination of Agreement - Either Party may terminate this agreement at any time
with or without cause by giving the other party reasonable advance notice of, at least
14 days. - In such event that “the Customer” is requesting termination, the Customer
shall have the obligation to pay TJC Home Improvement, LLC for Services properly
rendered or special materials previously ordered prior to the date of requested
termination. These Services include but are not limited to: (Building Permits, Business
Taxes paid to a specific municipality, Asbestos Testing Facilities, and Office/clerical
expenses). Payments are to be made to TJC Home Improvement, LLC upon acceptance
of requested Termination of Agreement.
- 5, Amendment to Agreement : This Agreement may only be amended by a written
agreement (Change order) executed by both Parties. Any such amendment shall be
specific in nature and shall outline and/or describe any physical changes, any changes
to the original scope of work, or any additional work to be completed by TJC Home
Improvement, LLC. Any amendments shall be agreed upon prior to the
commencement of the project when possible.
- 6, Representations by TJC Home Improvement, LLC - TJC Home Improvement, LLC
warrants to the Customer that TJC Home Improvement, LLC is qualified to perform
the Services outlined in this agreement. All Services performed, including materials
used, will conform with generally accepted Industry Standards. TJC Home
Improvement, LLC shall perform the Services and provide all materials in full
compliance with the terms of this Agreement, and all applicable laws and
regulations.
- 7, Applicable Law - The laws of the State of West Virginia govern this Agreement.
- 8, Arbitration -Arbitration - Any controversy or claim arising out of or relating
to this Agreement, or
any breach of this Agreement is to be
settled by arbitration in accordance with the commercial Arbitration Rules of the
American Arbitration Association, and any judgment upon award rendered by the
arbitrator(s) may be entered in any court having jurisdiction.
- 9, Attorney’s Fees - Should a dispute arise in relation to this agreement of the work
performed, the parties shall be liable for their own attorney’s fees and cost.
However, should TJC Home Improvement, LLC be forced to collect any unpaid
balance owed by “the Customer” through legal proceedings and/or collection
agencies. “The Customer” shall pay reasonable attorney collection fees incurred by
TJC Home Improvement, LLC.
- 10, Severability - If any provision of this Agreement is held invalid, illegal, or
unenforceable, the rest of this Agreement remains in effect.
- 11, Assignment - No party may assign this Agreement to an outside party without
the prior written consent of the other parties. Any attempted assignment is
ineffective and void.
- 12, Headings - The headings of the sections and subsections of this Agreement are
for convenience only and do not constitute a part of this Agreement.
- 13, Headings - The headings of the sections and subsections of this Agreement are
for convenience only and do not constitute a part of this Agreement.
- 14, Counterparts - This Agreement may be executed in two or more counterparts,
any one of which shall be deemed the original without reference to the others.
Force Majeure - Neither party is responsible for the fulfillment of any term or provision of this Agreement if the fulfillment is delayed or prevented by revolution or disorders, war, terrorism, acts of enemies, fires, acts of God, or without limiting the foregoing, by any other cause beyond the control of the party whose performance is interfered with and which, by the exercise of reasonable diligence, the party is unable to prevent.
- 15, Non-Waiver - Delay or failure of any party to exercise any right under this
Agreement
does not operate as a waiver of that right or otherwise prejudice the party from
exercising that right in the future.
- 16, Notices - Any notice required or permitted to be given under this Agreement
shall be
sufficient if in writing and if sent by registered mail to TJC Home Improvement LLC at
its principal executive offices or to the Customer at the last address filed by him/her
in writing with TJC Home Improvement LLC, as the case may be.
- 17, Successors and Assigns - This Agreement is binding upon and shall be used to
the
benefit of the Parties themselves, as well as their respective representatives,
successors, permitted assigns, heirs and estates. No assignment relieves the
assigning party of its obligations under this Agreement.
- 18, Third Party Beneficiaries - This Agreement does not and is not intended to
confer any
rights or remedies upon any person other than the Parties to this Agreement.
- 19, Integration - This Agreement is the entire agreement and understanding of the
Parties with respect to the subject matter of this Agreement. This Agreement
supersedes all prior and contemporaneous agreements and understandings of the
Parties in connection with the subject matter of this Agreement.
Any changes and or additional task requested by the customer will need to contact project manager / coordinator to request change or additions to be made. Crew on site does not have authorization to make changes that are not on scope of work. An additional charge of $300 for each change order will be added to the cost of the invoice for the additional work to be completed. This estimate is based on current material costs. Due to the current volatile market, material cost are subject to change. TJC will inform you prior to starting if there are any price changes.
